Promotion of Access to Information Manua

Introduction:

The information in this manual applies to Lyca Mobile South Africa (Pty) Limited (“Lyca Mobile”) with Registration Number 2012/081978/07. Lyca Mobile operates telecommunications services under an Individual Electronic Communications Network Service licence and an Individual Electronic Communication Services licence. In terms of Section 51(1) of the Promotion of Access to Information Act No.2 of 2000 (“the Act”), Private bodies such as Lyca Mobile are required to compile and publish a manual with the information set out herein. In terms of Section 51(2) of the Act, the head of a Private Body must, on a regular basis, update this manual. Based on the provisions of this section, Lyca Mobile will as and when it deems it necessary update or amend this manual. The head of Lyca Mobile has delegated the functions under the Act to the Information Officer. This manual will also explain how you may make a request to access information that you are entitled to access, how to make a request to change your personal information, and also how you may make a request to delete or destroy your personal information

At the time of publication of this manual, the Minister had not published any description of records available without a person having to request access in terms of this Act as provided for in terms of Section 52(2)

Requirements in terms of Section 51(1)(d)
Lyca Mobile keeps records in terms of the following:

Employment Equity Act 55, 1998

All documents of incorporation of Lyca Mobile are lodged at the offices of the Registrar of Companies, and may be inspected there. These documents include the Memorandum of Incorporation, as well as the relevant company forms

The register of members and register of transfers (of members), pledges and bonds of Lyca Mobile are available for inspection at the registered office of Lyca Mobile

Special resolutions are lodged with the Registrar of Companies, and may be inspected there.

A register of the directors’ and officials’ interests in contracts entered into by Lyca Mobile is kept.

Telecommunications Act.

      • • Lyca Mobile, as a licensee, is obliged to keep accounts and records pertaining to the provision of its telecommunications services.

Individual Electronic Communications Service Licence & Individual Electronic Communications Network Service Licence

        • • Lyca Mobile has contracted service providers and/or dealers as an interface with its subscribers. Service providers and/or dealers operate their own businesses. A list of Lyca Mobile’s service providers and dealers is available on its website.
      • • Lyca Mobile is obliged to lodge and get approval in writing from the Authority (ICASA) on tariffs and fees for its services and further to keep records thereof.

The Regulation of Interception of Communications and Provision of Communication Related Information Act 70 of 2002
• Lyca Mobile is obliged to store communication related information
• Lyca Mobile is obliged to keep proper records of information to be obtained and kept in respect of cellular phones and SIM-Cards

Requirements in terms of Section 51(1)(e) for a description of the subjects on which the Private Body holds records and the categories of records held on each subject
This section of the Manual sets out the subject and categories of records held by Lyca Mobile. The inclusion of any subject or category of records should not be taken as an indication that records falling within those subjects and/or categories will be made available under the Act. In particular, certain grounds of refusal as set out in the Act may be applicable to a request for such records.

Lyca Mobile will not collect or process customer personal information without obtaining the customer’s consent. Your consent is obtained in terms of a legally binding agreement, which includes the applicable commercial terms and conditions such as the Prepaid Sim Card Terms and Conditions and the Website and Online Services Terms and Conditions.
By registering your SIM Card for purposes of the Regulation of Interception of Communications and Provision of Communication-Related Information Act 70 of 2002 (“RICA”), and your subsequent use of the services offered by Lyca Mobile, you are accepting the terms and conditions and providing Lyca Mobile with consent for the processing of your personal information.

Direct Marketing
You have the right to choose whether you receive marketing material or not. By accepting the terms and conditions you are also agreeing to Lyca Mobile sending you marketing material on related services, products and offerings provided from Lyca Mobile from time to time. If you change your mind at any time, you are always able to opt out.
We will comply with the direct marketing provisions of the Consumer Protection Act No 68 of 2008 (“CPA”) and the CPA regulations, including the provisions relating to the direct marketing registry.

Your Information Choices
Changing your information
You can review the personal information you provided to us and make any desired changes to the information you have provided. Please be aware that even after your request for a change is processed, Lyca Mobile may, for a time, retain residual information about you in its backup and/or archival copies of its database. Deletion or destruction of your information
You may request that we delete and destroy any of your personal information provided that you have finalised your relationship with Lyca Mobile. Lyca Mobile will however retain and use your personal information for as long as is necessary to comply with our legal and business obligations and resolve disputes.
